The U.S. International Trade Commission has issued a preliminary ruling in favour of Infineon Technologies in a patent infringement dispute with Chinese chipmaker Innoscience, a decision that could pave the way for an import ban on certain gallium nitride products entering the United States.
In its determination, published today, the ITC found that Innoscience had violated one Infineon patent relating to gallium nitride technology, and confirmed the legal validity of both patents asserted in the case. A final ruling is expected on 2nd April 2026, and, if upheld, would block the import of Innoscience devices deemed to infringe Infineon’s intellectual property.
Johannes Schoiswohl, Senior Vice President and Head of Infineon’s GaN Systems Business Line, said the decision underscored the strength of the German group’s intellectual property, and reaffirmed its commitment to defending its technology. He added that Infineon would continue to invest in innovation across power semiconductors used in applications from decarbonisation to digital transformation.
The US move is the latest in a series of positive legal outcomes for Infineon in its multi-jurisdictional dispute with Innoscience. In Germany, the patent office recently upheld one of Infineon’s GaN patents in amended form, and the Company is pursuing infringement claims before the Munich District Court. In August, the Munich District Court I found that Innoscience had infringed another Infineon patent.
Infineon, one of the largest integrated device manufacturers in the GaN sector, holds roughly 450 GaN patent families. The compound semiconductor is increasingly important in high-performance, energy-efficient power systems used in renewable energy, AI data centres, industrial automation, and electric vehicles. GaN components offer greater power density, faster switching, and reduced energy losses, enabling more compact designs and lower heat generation.
Based in Munich, Infineon employs about 57,000 people and generated €14.7 billion in revenue in the financial year to 30th September 2025. The Company is listed in Frankfurt under the ticker IFX, and trades in the USA on the OTCQX market under IFNNY.
